Eligibility: Employees (and employees' immediate family or household members) of Sponsor, and its parent, affiliates, subsidiaries, suppliers, printers, distributors, advertising and promotional agencies, and prize suppliers are not eligible to participate in the Contest. 3. Privacy: By entering the Contest, you agree to Sponsor's use of your personal information as described in its Privacy Statement at http://www.alloy.com 4. Winner Selection: All eligible entries received by the end of the Contest closing date will be judged by representatives of Sponsor. All entries submitted in accordance with the submission guidelines contained in these Official Rules will be judged on the basis of the following criteria: 25% Clarity, 25% Originality and 50% Creativity. Winners will be notified by email. Potential winners must accept the Prize within three (3) business days of notification. Any winner notification not responded to or returned as undeliverable may result in Prize forfeiture then an additional judging from all eligible entries will be made to determine an alternate winner. General Conditions: The Sweepstakes is governed by the laws of the United States and the State of New York without giving effect to the conflict of laws or rules thereof. In the event of a dispute, all actions shall be heard by the state or federal courts located in the State of New York without resort to any form of class action. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred including, without limitation, costs associated with entering this Contest, but in no event attorneys' fees. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to entrants' or to any other person's computer related to or resulting from participating or downloading materials in the Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. In the event of a dispute concerning who registered online to participate in the Contest, the registration will be declared to have been made by the authorized account holder or the email address submitted at the time of registration. The authorized account holder is defined as the natural person who is assigned to an email address by an internet provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
